Giants tackle Diehl charged with DWI

A judge released Giants starting left tackle David Diehl from custody Monday after he spent the night locked up for allegedly being under the influence and smashing into parked cars.

Diehl was busted for DWI in Queens on Sunday night, with his blood-alcohol level allegedly at .18, more than twice the legal limit, authorities said.

The Big Blue lineman, a member of the Giants' past two Super Bowl teams, told cops he was pulling out of a street parking spot when he was hit by another car, prosecutors said.

But law enforcement sources alleged that Diehl, 31, drove his black BMW into two vehicles on 35th Avenue near 31st Street in Astoria at around 8:20 p.m.

Diehl was released on his own recognizance.

The judge ordered Diehl's driving privileges suspended in New York state. His driver's license is from New Jersey.

He jumped into the back of a black BMW and made no comment as he left court, but broke his silence on Twitter later Monday with an apology.

"I've worked hard during my career to set a positive example and yesterday I fell far short of this standard," Diehl tweeted.

"I apologize to my family, my fans, my teammates, the New York Giants, and the NFL. I made a poor decision that I sincerely regret, and, as always, take full responsibility for my actions."

A statement released by the Giants said, "Obviously we are aware of the situation, although we have not yet had a chance to discuss it with David.

"Since it is an ongoing legal matter, we will refrain from comment at this time, although we will say that David has been an outstanding representative of this organization for the past 10 years, and nobody knows more than David does what is expected of our players both on and off the field."

Diehl's agent, Peter Schaffer, would say only that the offensive lineman is "one of ... the classiest, most humblest New York Giants ever."

Diehl, who has been with the team since being drafted in 2003, won the Wellington Mara NFL Man of the Year Award on May 22 at the annual Boys Hope Girls Hope Dinner at The Pierre hotel.
